Terms and conditions

GENERAL TERMS

The terms and conditions of sale apply to the rights and obligations arising from the purchase of goods between customers (hereinafter referred to as the Client) of the Sisbond.com online store and Hyggesh OÜ (hereinafter referred to as the Seller).

The Seller sells and the Client purchases products offered in the online store.

The selection of products, prices, and discounts in the online store may differ from those available with other retailers.

A sales contract between the Seller and the Client enters into force upon receipt of the payment due for confirmation of the order to the Seller’s bank account.

Products are not reserved before the sales contract enters into force.

In addition to these terms, the legal relationships arising from the purchase of products through the online store are regulated by the laws of the Republic of Estonia.

The Seller reserves the right to change the terms of use of the online store, as well as the prices of products and services. The Seller shall inform about the changes in the online store environment. The terms and prices in force at the time of the transaction shall apply.

PRICE

The prices of the products are presented in euros and include VAT (22%).

In addition to the price of the products, a handling fee for the selected delivery method is added during the ordering process. The delivery method is selected and the delivery fee is calculated in the shopping cart.

PLACING AN ORDER

An order is considered placed and a sales contract concluded between the Seller and the Client after the invoice has been paid by the Client.

PAYMENT FOR THE ORDER

Orders placed in the online store are paid in full in advance by credit card.

When paying for the order, the Client can choose a suitable payment method: Swedbank, SEB Pank, Coop, LHV Pank, Luminor, Citadele, Revolut, or N26 bank link or credit card.

Payment for the products and the order is made in a secure payment environment outside the online store, mediated by Montonio Finance UAB.

The Seller does not have access to the Client’s bank or credit card data.

After placing and paying for the order, the Client will receive an order confirmation by email, and an invoice will be added to the shipment upon delivery.

DELIVERY OF THE ORDER

The Sisbond.com online store delivers goods in the Baltic States.

The products are delivered to the customer via Smartpost parcel terminals. Smartpost is convenient, fast, and 100% weatherproof. Smartpost parcel terminals are located in various locations throughout the Baltic States, and you can choose the most convenient terminal location.

Unless otherwise indicated, the customer pays for handling the shipment. Depending on the destination, the shipment fee is:

  • Estonia €2.90
  • Latvia €3.90
  • Lithuania €3.90

Deliveries are free of charge for orders over €79.

Orders are processed and dispatched on the same or next working day. Estimated delivery times in the Baltic States: 1-4 working days (up to 10 working days during sales).

RETURN OF PRODUCTS

In accordance with § 56 (1) of the Law of Obligations Act, the customer has the right to withdraw from the contract within 14 days of receiving the goods.

The returned goods must be unused, undamaged, and in their original packaging.

The customer bears the cost of returning the goods, except in cases where the reason for the return is non-compliance with the order or defective goods.

To return the goods, a free-form declaration of withdrawal must be sent to the email address [email protected] within 14 days of receiving the goods. The declaration must include the customer’s name, product name, and invoice or order number.

The amount paid for the returned goods will be refunded to the customer immediately, but no later than 14 days after receiving the withdrawal declaration. In addition to the cost of the returned goods, the shipping costs will also be refunded.

When returning the goods, a parcel terminal must be used, and the document received upon dispatching the goods must be kept as proof of dispatch, as Hyggesh OÜ cannot be held responsible until the returned products have been received.

OTHER IMPORTANT TERMS REGARDING THE RIGHT OF WITHDRAWAL

In accordance with the Law of Obligations Act, the customer has the right to file complaints about non-compliance with the terms of the contract within 2 years of receiving the product, with the presumption that any defect occurring within the first six months was present at the time of purchase, and the nature of the defect must be determined by the Seller.

In the event of a defect in the product/products, the customer undertakes to inform Hyggesh OÜ about the problem by email to [email protected] and provide the following information: name, contact details, and product defect. The corresponding statement must be sent no later than two months after the defect is discovered.

Hyggesh OÜ is not liable for:

Damage to the product caused by the customer’s fault or negligence.

Defects resulting from the non-intended use of the product.

Natural wear and tear of the product/products under normal use.

CANCELLATION OF THE ORDER BY THE SELLER

In the event of the ordered product being unavailable, the Seller cancels the order. The order can be canceled partially or completely. The Seller immediately informs the Customer of the canceled order. In the case of partial cancellation, the Seller may inquire about the Customer’s preferences regarding handling the remaining order – whether to ship or also cancel it.

In the event of order cancellation, the amount paid by the Customer to the Seller is refunded without delay but no later than within 14 days.

LIABILITY AND FORCE MAJEURE

The Seller is liable to the Customer and the Customer is liable to the Seller for damages caused by a breach of these terms under the cases and to the extent provided for in the laws of the Republic of Estonia.

The Seller is not liable for damages caused to the Customer or for delays in product delivery if the damage or delay in delivery is due to circumstances beyond the control or foresight of the Seller.

Any disputes or disagreements arising from these terms shall be resolved primarily through negotiations between the parties. If disputes arising from the contract cannot be resolved through negotiations between the parties, the Customer has the right to appeal to the Consumer Protection Board or the court to protect their rights. The Seller has the right to go to court to protect their rights.

PROCESSING OF CUSTOMER PERSONAL DATA AND PRIVACY

By using the Sisbond.com website, the Customer gives clear and informed consent to the processing of their personal data by the Seller.

The Seller uses the information provided by the Customer solely for fulfilling the Customer’s purchase orders and does not disclose it to third parties.

Hyggesh OÜ processes the Customer’s personal data in accordance with the requirements of the Personal Data Protection Act.

The processed personal data includes the information requested from the Customer when placing an order in the online store (first and last name, address, phone number, email address, contents of the shopping cart, and purchase history).

Hyggesh OÜ processes the Customer’s personal data for order fulfillment (including sending order-related notifications), payment for products, delivery of products, preparation and transmission of offers and news to regular customers.

The responsible data controller for the Customer’s personal data is Hyggesh OÜ.

Hyggesh OÜ does not transfer the Customer’s personal data to third parties, except in the following cases:

To service providers (Itella SmartPost for courier services, Montonio Finance UAB for payment solutions, AS Merit Aktiva for accounting) to the extent necessary for the delivery of products to the Customer or the use of services;

For collecting statistics (Google Analytics, Facebook, Instagram) – information collection for the purpose of improving the user experience of the online store.

In the cases specified in previous two clauses, the Customer’s personal data is processed solely for the purpose of order fulfillment, and authorized processors ensure the same level of protection of personal data as Hyggesh OÜ.

The Customer has the right to access their personal data at any time and request its modification or deletion, unless otherwise provided by law, by submitting a request to Hyggesh OÜ by email to [email protected].

If the Customer has expressed a desire and given consent to receive newsletters and/or personalized offers prepared by Sisbond.com, the Customer has the right to withdraw this consent at any time by sending a corresponding notification to Hyggesh OÜ at [email protected].

The Customer has the right to request the transfer of their personal data to another data processor by submitting a digitally signed application to Hyggesh OÜ by email to [email protected]. Hyggesh OÜ has the right to refuse to directly transfer personal data to another data processor if, in the assessment of Hyggesh OÜ, the transfer of data to a third party is not secure.

If the Customer believes that their rights are being violated by the processing of personal data in the Sisbond.com online store, the Customer has the right to appeal to the Data Protection Inspectorate and the court.

These terms and conditions are governed by and construed in accordance with the laws of the Republic of Estonia. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Estonia.

If any provision of these terms and conditions is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

The headings used in these terms and conditions are for convenience only and shall not affect the interpretation of the provisions.

No failure or delay by Hyggesh OÜ in exercising any right, power, or privilege under these terms and conditions shall operate as a waiver thereof, nor shall any single or partial exercise thereof preclude any other or further exercise thereof or the exercise of any other right, power, or privilege.

These terms and conditions constitute the entire agreement between the customer and Hyggesh OÜ relating to the subject matter herein and supersede all prior or contemporaneous understandings, agreements, negotiations, representations, and warranties, whether oral or written.

Any notices or communications required or permitted to be given under these terms and conditions shall be in writing and shall be deemed to have been duly given if delivered personally or sent by prepaid registered post or email to the respective parties at the addresses provided herein.
